Rule 34
Formation of Inquiry Committee
(1) Except in the case of sub-section (2) of section 63 and sub-section (2) of section 69 of the Act, the Government of Nepal has been or is qualified to be a judge of the Supreme Court to investigate a member of the Tribunal or the Appellate Tribunal on the charge of not conducting himself according to his position or being unable to perform his duties. An investigation committee will be formed under the chairmanship of the person who reached.
(2) The inquiry committee under sub-rule (1) shall exercise the same powers as the court in relation to giving information to the accused member, ordering information, taking statements, and taking witness evidence.
(3) The investigation committee as per sub-rule (1) may understand any person related to it in addition to the accused member in carrying out the investigation.
(4) The inquiry committee as per sub-rule (1) may study and inspect the orders, decisions and actions taken by the accused members in connection with the case during the inquiry and may request written explanations from such members after giving reasonable opportunity.
(5) Other procedures related to the investigation of the investigation committee as per sub-rule (1) shall be as determined by the said committee.
